INTRODUCTION


Clark, Farb, Fiksel came together on August 1st, 1989 to practise in association and subsequently formed a partnership on January 1, 1999.

 

The firm provides our clients with direct access to five lawyers.  We utilize state of the art computer, network and communication technology so as to maintain the highest possible standard of service to our clients without compromising "small firm" contact and accessibility.

 

Our offices are located at 188 Avenue Road in downtown Toronto, and the offices were designed in this law firm owned building to combine the comfort and charm with the efficiency and technology of a modern office setting.

NATURE OF LEGAL PRACTICE

 

The firm practises extensively in the areas of corporate and commercial law, family law, civil litigation and real estate (commercial, residential and leasing), wills, estates and trusts, and as well, carries on a full general practice. Our lawyers regularly participate in educational programs sponsored by the Law Society and the Canadian Bar Association in order to be on the crest of recent trends and developments in the law.

 

CORPORATE/COMMERCIAL

 

Our corporate and commercial practice facilitates almost all corporate and commercial matters including, the incorporation, organization and re-organization of companies, the preparation of shareholder and partnership agreements and trust documents, the acquisition and sale of assets and shares of businesses, financing (mortgages, debentures, secured transactions, etc.) as well as drafting and opining on a variety of commercial documents, agreements and security instruments.

 

We make ourselves available to the business manager for ongoing corporate advice for everyday business matters and for negotiations involving all aspects of your business.

 

The firm has access to a number of professional firms including accountants, merchant bankers, real estate and business brokers and management consultants for additional expert input as such needs arise.  The partnership collectively is counsel to well over 300 corporations.

REAL ESTATE

 

We act for individuals as well as corporations in a variety of businesses and enterprises and we understand fully the importance to our clients of real estate related transactions.

 

Our expertise in this field permits us to meet our clients' needs in the purchase or sale of all manner of commercial and residential real estate and mortgage transactions.

 

Our firm is also able to serve clients with commercial and residential leasing and landlord and tenant problems, fully recognizing the complex issues surrounding the leasing of property.  We are able to assist in every stage of the commercial leasing transaction from evaluation of sites to preparation of the offer and successful negotiation and execution of your lease.

FAMILY LAW

 

We have considerable experience in all areas of family law including divorce, custody and access, support, division of property, separation agreements, marriage contracts, paternity, and adoption.

 

We have had extensive experience in negotiating favourable settlements for clients and in conducting effective litigation where required.  We utilize referrals to mediation and assessment services and are able to direct clients to other community resources such as psychologists, psychiatrists, social workers, and marriage counsellors.

 

We also conduct mediation in family law matters to assist clients to attempt negotiated settlements in a non-adversarial way.

 

CIVIL LITIGATION

 

We offer a broad range of capabilities in litigation matters, including commercial litigation, wrongful dismissal, negligence, contractual disputes, personal injury claims and construction liens.  Our lawyers also appear before Provincial administrative tribunals and agencies dealing with a variety of concerns.

 

A substantial amount of our litigation is referred to us by other law firms and from satisfied clients.  We feel that this confirms the integrity, tact and confidentiality which our clients require.

WILLS, ESTATES AND TRUSTS

We work with clients and their accountants to implement Estate plans and we prepare wills, powers of attorney and trusts to assist our clients in the orderly passing of their estates and minimization of taxes on death. We also assist Estate trustees in the Administration of those Estates.

Converted an Honours Program in Philosophy and Psychology into a B.A. (Phil) at the University of Guelph, 1971; graduate of the University of Toronto Faculty of Law (LL.B. 1975); articled with Kennedy and Kennedy, and Tory, Tory, DesLauriers and Binnington (1976-1977); called to the Ontario Bar in April 1978; practised general litigation with Strauss & Strauss, (1978 - 1980); General Counsel to The Ombudsman of Ontario, (1980 -1982); private practice of law in Toronto from 1983 to date; Senior Counsel to Farb and Associates, (1986 - 1989); Vice-Chairman (part-time) at Worker's Compensation Appeal Tribunal, (1987 - 1990); General Litigation Counsel to CFF, (1989 to present).

Education and Professional History

 

Completed a Bachelor of Arts Degree at the University of Toronto in 1971; graduated from the Faculty of Management Studies at the University of Toronto with a Masters in Business Administration in 1973; worked for the Faculty of Applied Science and Engineering at the University of Toronto as the Assistant Secretary for one year before attending the University of Windsor Law School and graduated with an LL.B. in 1977; articled with McKeown, Yaeger, Spearing & Champlin in Toronto (1977 - 1978); called to the Ontario Bar in 1979.

 

 

In private practice since the Call to the Bar; practise specializing in Real Estate and Corporate Commercial law, (currently corporate counsel to over 100 closely held corporations and to a number of non profit associations), wills and estates.

G. BRUCE CLARK

Education and Professional History

Completed a Bachelor of Mathematics Degree at the University of Waterloo, 1971; graduate of the University of Toronto Law School (LL.B. 1974); articled with Blackwell, Law, Treadgold and Armstrong in Toronto (1974 - 1975); called to the Ontario Bar in 1976.

 

Practised family law in Toronto since 1976.  Also has a family mediation practice.

 

 

Professional Activities and Memberships

Member, Canadian Bar Association;

 

Lectured at programmes in family law to mental health professionals at York University conference on sexual abuse and to Durham Elementary and Secondary teachers on children's rights.

Panel member for Office of the Childrens’ Lawyer for 12 years in custody and access and child welfare matters.

Advised residents, clients and staff at a number of Toronto shelters for abused women including Women's Habitat, Evangeline Residence, Barbra Schlifer Clinic and Interval House;
